These Terms and Conditions ("Terms") govern the use of services offered by Player Development Platform LLC ("PDP," "we," "our," or "us"). By accessing our website, submitting a consultation request, signing up for services, or interacting with our coaching platform, you ("Client," "you," or "your") agree to be bound by these Terms, whether or not a paid contract is entered into.
0. Definitions

“Service”: Refers to all offerings by PDP, including coaching calls, video analysis, progress tracking, onboarding, and consulting.

“Session”: A scheduled one-on-one consultation, training call, or review meeting conducted via video.

“On-Time Delivery”: Provision of materials or sessions as agreed upon in your selected package, unless delayed by force majeure or technical issues.

“Platform”: The PDP web-based or third-party applications used to deliver services or collect performance data.
1. Scope of services
PDP offers personalized development for athletes through:

Initial consultation (free) via email and video

Package selection (Base or Premium)
-
Regular coaching sessions (weekly or bi-weekly)
-
Video analysis submissions and highlight reel creation
-
Progress tracking and performance reporting
-
Mindset mentorship and developmental feedback
Services are subject to package limitations and may include additional features (e.g., highlight video production or college guidance) depending on the client’s selection.
2. Service Agreement
By engaging in any step of our service process—including submitting an intake form, receiving a proposal, or attending a free consultation—you agree to the following service terms:

3.1: You understand PDP provides developmental and mentorship services only, not medical or diagnostic treatment.

3.2: You agree to be honest and timely with your submissions (e.g., video footage, feedback, assignments).

3.3: PDP may collect and process data related to your performance, footage, and mindset for service delivery purposes (see Privacy Policy).

3.4: You acknowledge that final decisions on athletic outcomes (e.g., recruitment, performance) are not guaranteed and depend on your effort and circumstances beyond PDP’s control.

3.5: PDP reserves the right to decline service to any client who violates these terms or demonstrates uncooperative or disrespectful behavior.
3. Client Obligations
Clients must:

Submit footage and assessments in a timely manner.

Attend scheduled sessions or notify of rescheduling at least 24 hours in advance.

Engage respectfully with coaches and mentors.
-
Provide accurate, current information during onboarding.

5. Payment Terms

5.1 Fees: Clients agree to pay the full amount as specified in the chosen service package (Base or Premium).

5.2 Payment Methods: Accepted via Stripe, Wise, PayPal, or bank transfer.

5.3 Refunds: All payments are final. PDP does not offer refunds for completed or missed sessions.

5.4 Late Payments: Access to services may be paused until payment is resolved.
6. Data Use & Consent
By using our services, you consent to PDP:

Collecting personal, performance, and psychological data for coaching purposes.

Using anonymized data in testimonials or internal analytics, if separate consent is provided.

Recording session notes and performance ratings to support your development.

7. Confidentiality & Intellectual Property

7.1: PDP will not share your videos, notes, or footage with third parties without your permission.

7.2: Clients may not reproduce or distribute PDP’s custom materials (e.g., drills, reports, techniques) without express written permission.

7.3: Highlight reels and reports provided to the client may be used freely by the client for personal promotion.
8. Termination

Either party may terminate service at any time:

8.1: Termination must be communicated in writing (email acceptable).

8.2: Unused sessions are forfeited upon termination unless otherwise agreed.

8.3: Upon termination, access to the platform and coaching portal may be revoked.
9. Disclaimers and Limitation of Liability

9.1: PDP is not responsible for injuries incurred during training or physical activity.

9.2: Services are provided “as-is” without warranties of specific outcomes.

9.3: PDP’s liability is limited to the amount paid by the client for services within the last 3 months.

9.4: Texas law permits such disclaimers under the Business & Commerce Code §1.401.
10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.
9. Disclaimers and Limitation of Liability

9.1: PDP is not responsible for injuries incurred during training or physical activity.

9.2: Services are provided “as-is” without warranties of specific outcomes.

9.3: PDP’s liability is limited to the amount paid by the client for services within the last 3 months.

9.4: Texas law permits such disclaimers under the Business & Commerce Code §1.401.
10. Amendments

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with the “Last Updated” date revised. Continued use of services after such changes constitutes your acceptance.
11. Tech & Platform Requirements

Clients must ensure stable internet access for video sessions.
-
Video uploads must meet basic resolution standards (minimum 720p recommended).
-
PDP is not liable for performance issues caused by technical problems outside its control.
12. Acceptable Use and Conduct
PDP maintains a zero-tolerance policy for:

Abusive or disrespectful behavior toward coaches or staff

Harassment, threats, or discriminatory conduct
-
Misuse of the platform for any purpose other than personal athletic development
-
Violation may result in immediate termination of services.
